TDL:aaa 112800 <br />C) For purposes of this Agreement, a "residential unit" shall include a single - <br />family house, a condominium unit, each apartment in an apartment building and each unit of a multiple unit <br />structure such as a duplex or triplex. <br />2) No Other Payments: The Port shall have no responsibility or obligation of any <br />kind whatsoever with respect to the Program, including any costs or expenses of the Program, except <br />solely as expressly provided in accordance with Section 2 and Section 3. <br />d) Execution of Easement: The City agrees to implement reasonable procedures, <br />consistent with prevailing procedures used by San Francisco Bay Area air carrier airports who implement <br />residential unit insulation programs, to assure that each Easement that the City provides to the Port in <br />accordance with this Agreement is signed by all persons who have a fee ownership interest. in the <br />residential unit(s) subject to the Easement. <br />e) No Sound Study: No sound studies for the City's Program are required under Section 2 <br />of this Agreement, and the Port shall not be obligated or responsible to pay for any sound studies. <br />f)Insulation: Subject to the terms, conditions and limitations of this Agreement, the Port <br />shall provide funding for the City to provide only the following insulation. measures: <br />1) New double pane windows and sliding glass doors, if applicable, with a STC rating <br />of 33 -35; <br />2) Weather stripping around windows and doors; and <br />3) A fresh air switch for the fumace fan if the residential unit does not already have <br />the switch and if the unit does not have air conditioning. <br />City of San Leandro and Port of Oakland <br />Settlement Agreement <br />Page 7
