TDCaaa 11n1188 <br />to insulate the units to. the extent necessary to reduce the interior Airport aircraft noise level in each <br />habitable room of the units to 45 dB CNEL. <br />The sound study process shall commence within 90 days after the termination or change in the <br />San Leandro Runway Use Policy. The City shall complete the sound study and contract specifications for. <br />the Additional Residential Units, and provide them to the Port. <br />b) Exceptions: Section 3(a) shall not apply to the following terminations or changes in the <br />Policy: <br />1) A termination or change that is mandated by law or.judicial or administrative order; <br />Of <br />2) A termination or change that will not result in any adverse aircraft noise impact on <br />the Davis West or Timothy Drive neighborhoods that are identified in Exhibit 1. <br />It is understood and agreed that aircraft operations that come within the exceptions listed <br />in clauses (a) and (b) of Section 1 will not comprise a termination or change to the Policy. <br />4.Mulford Gardens Branch Library. <br />a) Sound Study: The Port shall conduct a sound study for the Mulford Gardens Branch <br />Library to establish the outside to inside noise reduction for the currently existing building. Based upon the <br />established noise reduction, the study shall then establish the projected interior aircraft noise level in the <br />reading rooms of the library for the Airport's peak air traffic hour during normal library hours, assuming the <br />worst case 2010 conditions (with mitigation) in the ADP SEIR. Normal library hours are: Mondays 2 - to <br />5:30 p.m. and 7 to 9 p.m.; Tuesdays 2 to 5:30; Wednesdays 10 to 12:00 p.m., 2 to 5:30 p.m. and 7 -9 p.m.; <br />Thursdays 2 to 5:30 p.m.; Fridays 2 to 5:30 p.m.; and Saturdays 10 to 12:00 p.m. and 1 to 5 p.m. If the <br />City of San Leandro and Port of Oakland <br />Settlement Agreement Page 13 <br />29848
