Alexander, Port Attorney <br />Port of Oakland <br />530 Water Street, 4th Floor <br />Oakland, CA 94607 <br />FOR RECORDER'S USE <br />GRANT OF EASEMENT AND RELEASE <br />This Grant of Easement and Release is made on 200_, by collectively] <br />Grantor "), , to the City of Oakland, a municipal corporation, acting by and through its Board of Port <br />Commissioners (the "Port"), is with reference to the following facts: <br />1. <br />A. Grantor owns real property in Alameda County, California ( "Grantor's Property "). The legal <br />description for Grantor's Property is attached as Exhibit "A ". Grantor's Property includes the air space above it. <br />B. The Port owns and operates the Metropolitan Oakland International Airport in Alameda <br />County, California (the "Airport"). The legal description for the Airport is attached as Exhibit "8 ". <br />C. The Port and the City of San Leandro ( "City") have entered into a Settlement Agreement dated <br />as of November 7, 2000 ( "Settlement Agreement "). The Settlement Agreement includes provisions for the Port to <br />make payments for the City's management and implementation of the City's Residential Airport Noise Insulation <br />Program, and, in exchange for grants of easement and release, to make payments for the City's costs of constructing <br />noise insulation improvements for the residential units that the City selects for.insulation. <br />D. Grantor has accepted the City's offer that Grantor participate in the City's Residential Airport <br />Noise Insulation Program, and Grantor and the City have agreed that in exchange for the City's agreement to <br />provide at no cost to Grantor certain modifications to the residential structures on Grantor's Property that are <br />intended to reduce aircraft noise heard inside the structures, Grantor will deliver to the Port this Grant of Easement <br />and Release. <br />GRANT OE EASEMENT AND RELEASE EXHIBIT 2 <br />30209
