Port of Oakland Settlement Negotiations on Airport Development Program Litigation Dear Commissioners: I am writing this letter in the temporary absence of the Port Attorney. The purpose of the letter is to describe to the Board, in preparation for a closed session discussion, the status of settlement negotiations between the Port and the City of San Leandro on the City's pending litigation challenging the Port's environmental review and approval of the Airport Development Program ADP "). I recommend that the Board at its October 29 closed session discuss the settlement negotiations with the Port Attorney. The purpose of the discussions would be two - fold.: First, to receive guidance from Board members on efforts to develop a final Settlement Agreement that Port staff and San Leandro City staff could recommend for approval .by their respective governing bodies • in November; and Second, to provide the Port Attorney information useful in responding to an expected motion by the City of San Leandro for an extension of time to file an appeal brief in the litigation.
