Port of Oakland Settlement <br />Negotiations on Airport Development Program Litigation <br />Dear Commissioners: <br />I am writing this letter in the temporary absence of the Port <br />Attorney. The purpose of the letter is to describe to the Board, <br />in preparation for a closed session discussion, the status of <br />settlement negotiations between the Port and the City of San <br />Leandro on the City's pending litigation challenging the Port's <br />environmental review and approval of the Airport Development <br />Program ADP "). <br />I recommend that the Board at its October 29 closed session <br />discuss the settlement negotiations with the Port Attorney. The <br />purpose of the discussions would be two - fold.: First, to receive <br />guidance from Board members on efforts to develop a final <br />Settlement Agreement that Port staff and San Leandro City staff <br />could recommend for approval .by their respective governing bodies • <br />in November; and Second, to provide the Port Attorney information <br />useful in responding to an expected motion by the City of San <br />Leandro for an extension of time to file an appeal brief in the <br />litigation.
