<br /> 3 <br /> <br /> <br />Section 65867. As required by Government Code Section 65867.5, City has found that the <br />provisions of this Development Agreement and its purposes are consistent with the goals, <br />policies, standards and land use designations specified in City’s General Plan. <br />N. On February 20, 2014, the City of San Leandro Planning Commission (the <br />“Planning Commission”), the initial hearing body for purposes of development agreement <br />review, recommended approval of this Development Agreement pursuant to Resolution No. <br />2014-02. <br />O. On ________, 2014, the City of San Leandro City Council (the “City Council”) <br />adopted its Ordinance No. ____ (the “Approving Ordinance”) approving this Development <br />Agreement and authorizing its execution. The Approving Ordinance will take effect on <br />______________, 2013 (the “Effective Date”). <br />P. For the reasons recited herein, City and Developer have determined that the <br />Project is a development for which this Development Agreement is appropriate. This <br />Development Agreement will eliminate uncertainty regarding Project Approvals (including the <br />Subsequent Approvals), thereby encouraging planning for, investment in and commitment to <br />develop the Property. Continued use and development of the Property will in turn provide <br />substantial employment and property tax benefits, and contribute to the provision of needed <br />infrastructure and housing for area growth, thereby achieving the goals and purposes for which <br />the Development Agreement Legislation was enacted. <br />Q. The terms and conditions of this Development Agreement have undergone <br />extensive review by City staff, the Planning Commission and the City Council at publicly noticed <br />meetings and have been found to be fair, just and reasonable and in conformance with the City <br />General Plan and the Development Agreement Legislation, and, further, the City Council finds <br />that the economic interests of City’s residents and the public health, safety and welfare will be <br />best served by entering into this Development Agreement. <br />NOW, THEREFORE, in consideration of the mutual covenants and promises set forth <br />herein, City and Developer agree as follows: <br />ARTICLE 1. <br />GENERAL PROVISIONS <br />1.1. Parties. <br />1.1.1. City. City is a California municipal corporation, with offices located at <br />835 East 14th Street, San Leandro, CA 94577-3767. “City,” as used in this Development <br />Agreement, includes City and any assignee of or successor to its rights, powers and <br />responsibilities. <br />1.1.2. Developer. Developer is a Delaware limited partnership, with offices <br />located at 520 South El Camino Boulevard, San Mateo, CA, 94402. “Developer,” as used in this <br />Development Agreement, includes any permitted assignee or successor-in-interest as herein <br />provided.
