City of San Leandro <br />Meeting Date: June 2, 2014 <br />Ordinance <br />Agenda Section:File Number:14-211 CONSENT CALENDAR <br />Agenda Number: <br />TO:City Council <br />FROM:Chris Zapata <br />City Manager <br />BY:Cynthia Battenberg <br />Community Development Director <br />FINANCE REVIEW:David Baum <br />Finance Director <br />TITLE:ORDINANCE Amending Title 4, Chapter 4-5 of the San Leandro Municipal <br />Code Relating to Peddlers, Solicitors, and Itinerant Merchants (provides for <br />consistency with state law pertaining to public street vending) <br />The City Council of the City of San Leandro does ORDAIN as follows: <br />SECTION 1. That a Chapter 4-34 of Article 4, entitled “Mobile Food Vending”, is <br />hereby added to the City of San Leandro Municipal Code, and shall, in its entirety, read as <br />follows: <br />Findings. <br />The City Council for the City of San Leandro finds that: <br />1.California Vehicle Code section 22455 allows municipalities to regulate mobile food <br />vending in order to protect public safety; and <br />2.Mobile food vending has the potential to pose dangers to the public health and welfare of <br />residents of the City of San Leandro, including specific negative impacts on public safety, <br />pedestrian and vehicular circulation and traffic . The City of San Leandro has a substantial <br />public interest to provide regulations regarding the vending from vehicles that prevent <br />health and safety hazards and preserve the public health, safety, and welfare related to <br />such activities, especially for residents and visitors to the City of San Leandro; and <br />3.The primary purpose of the City’s public streets and rights -of-way is to facilitate the free <br />passage of vehicles, bicycles and pedestrians; and <br />4.The City of San Leandro intends to regulate mobile food vending in a manner that protects <br />the public health, safety, and welfare, while also accommodating mobile food vending <br />activity that promotes unique businesses and an active and social pedestrian environment. <br />However, the unregulated use of the public streets and rights-of-way by mobile food <br />vendors makes public streets and rights-of-way unsafe for vehicles, bicycles and <br />Page 1 City of San Leandro Printed on 5/27/2014
