r IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 99- 61 (1120/1313-B) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO DESIGNATING THE USE OF 20% TAX INCREMENT HOUSING SET-ASIDE MONIES FOR DEVELOPMENT OF LOW AND MODERATE INCOME HOUSING BOTH INSIDE AND OUTSIDE THE WEST SAN LEANDRO/MACARTHUR BOULEVARD REDEVELOPMENT PROJECT AREA 1. The City Council of the City of San Leandro is in the process of adopting a Redevelopment Plan for the West San Leandro/MacArthur Boulevard Redevelopment Project Area; and 2. The San Leandro Redevelopment Agency (the "Agency") is preparing a Redevelopment Plan for the West San Leandro/MacArthur Boulevard Redevelopment Project Area; and 3. Section 33334.2 of the California Community Redevelopment Law (Health and Safety Code Section 33000 et seq.) requires that not less than twenty percent (20%) of all taxes so allocated be used by the Agency for the purpose of increasing and improving the community's supply of low and moderate income housing (the community being defined in the Community Redevelopment Law as the City of San Leandro); and 4. Section 33334.2(g) of the California Community Redevelopment Law provides that the Agency may use such funds outside the Project Area if a finding is made by resolution of the Agency and the City Council of the City of San Leandro that such use will be of benefit to the Project; and 5. The State Legislature has found that the provision of affordable housing by redevelopment agencies is of particular benefit and assistance to the community. NOW, THEREFORE, the City Council of the City of San Leandro does hereby resolve as follows: Section 1. The use of taxes allocated from the Project Area for the purpose of increasing and improving the community's supply of low and moderate income housing outside the Project Area and within the City of San Leandro will be of 1
