r <br /> IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 99- 61 (1120/1313-B) <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> DESIGNATING THE USE OF 20% TAX INCREMENT HOUSING <br /> SET-ASIDE MONIES FOR DEVELOPMENT OF LOW AND <br /> MODERATE INCOME HOUSING BOTH INSIDE AND <br /> OUTSIDE THE WEST SAN LEANDRO/MACARTHUR BOULEVARD <br /> REDEVELOPMENT PROJECT AREA <br /> 1. The City Council of the City of San Leandro is in the process of adopting a <br /> Redevelopment Plan for the West San Leandro/MacArthur Boulevard Redevelopment <br /> Project Area; and <br /> 2. The San Leandro Redevelopment Agency (the "Agency") is preparing a <br /> Redevelopment Plan for the West San Leandro/MacArthur Boulevard Redevelopment <br /> Project Area; and <br /> 3. Section 33334.2 of the California Community Redevelopment Law (Health <br /> and Safety Code Section 33000 et seq.) requires that not less than twenty percent <br /> (20%) of all taxes so allocated be used by the Agency for the purpose of increasing <br /> and improving the community's supply of low and moderate income housing (the <br /> community being defined in the Community Redevelopment Law as the City of San <br /> Leandro); and <br /> 4. Section 33334.2(g) of the California Community Redevelopment Law <br /> provides that the Agency may use such funds outside the Project Area if a finding is <br /> made by resolution of the Agency and the City Council of the City of San Leandro <br /> that such use will be of benefit to the Project; and <br /> 5. The State Legislature has found that the provision of affordable housing by <br /> redevelopment agencies is of particular benefit and assistance to the community. <br /> NOW, THEREFORE, the City Council of the City of San Leandro does <br /> hereby resolve as follows: <br /> Section 1. The use of taxes allocated from the Project Area for the purpose of <br /> increasing and improving the community's supply of low and moderate income <br /> housing outside the Project Area and within the City of San Leandro will be of <br /> 1 <br />
