14 <br /> 4. meets the density restrictions of the State Housing Code. <br /> WHEREAS, the Zoning Enforcement Official interpreted a safe house to be <br /> within the definition of"Group Residential." <br /> WHEREAS, the San Leandro Shelter for Women and Children timely <br /> appealed the Zoning Enforcement Official's interpretation to the Planning <br /> Commission. <br /> WHEREAS, on May 5, 1999, the Planning Commission upheld the Zoning <br /> Enforcement Official's interpretation. <br /> WHEREAS, on May 7, 1999, the San Leandro Shelter for Women and <br /> Children timely appealed the Planning Commission's determination to the City <br /> Council. <br /> WHEREAS, a safe house with the above characteristics fits the definition of <br /> "family" in the Zoning Code rather than the definition of"group residential" because <br /> the residents live in a single housekeeping unit and pedestrian and automobile traffic <br /> is limited due to the strict confidentiality requirements and high number of children <br /> residing at the location. <br /> WHEREAS, the specific definition of a "safe house" set forth in this <br /> Resolution will ensure that this interpretation will not apply to group living situations <br /> that are not actual safe houses. <br /> WHEREAS, this interpretation of the Zoning Code is not a project as defined <br /> by the California Environmental Quality Act. <br /> WHEREAS, this interpretation is consistent with the Housing Element of the <br /> General Plan, including but not limited to the following goals, objectives and policies <br /> in the General Plan: <br /> 1. support programs providing emergency shelter and related services <br /> for persons and families who are temporarily homeless (Policy 7); <br /> 2. support programs that encourage the more efficient use of existing <br /> housing (Policy 11); <br /> 2 <br />
