t <br /> AGREEMENT <br /> In consideration of the mutual promises contained herein, the Parties agree as <br /> follows: <br /> 1. Recitals. <br /> The foregoing recitals are true and correct. <br /> 2. Definitions. <br /> As used in this Agreement: <br /> A. "Board of Supervisors" means the Board of Supervisors of the <br /> County of Alameda and governing body of the ACFD. <br /> B. "First Line Engine" means a fire truck (i) not equipped with an <br /> attached 100 foot aerial ladder and (ii) intended to be <br /> continuously operational and in service. <br /> C. "Reserve Engine" means a fire truck (i) not equipped with an <br /> attached 100 foot aerial ladder, and (ii) intended to be in service <br /> only during those times when a First Line Engine is out of service. <br /> D. "First Line Truck" means a fire truck (i) equipped with an <br /> attached 100 foot aerial ladder, and (ii) intended to be <br /> continuously operational and in service. <br /> E. "Reserve Truck" means a fire truck (i) equipped with an attached <br /> 100 foot aerial ladder, and (ii) intended to be in service only <br /> during those times when a First Line Truck is out of service. <br /> F. "County" means the County of Alameda. <br /> G. "Fire Chief' means the chief executive officer of the ACFD. <br /> 3. Ownership of Fire Truck. <br /> A. Sale and Purchase of Ownership Interests. <br /> (1) ACFD. Dublin sells to ACFD 55% ownership of Truck in <br /> Agreement Between City of Dublin, City of San Leandro and Page 2 of 12 <br /> ACFD Regarding Joint Ownership of a 1994 LTI Truck March 10, 1999 <br />
