F r r i s AMENDMENT NO. 1 TO AGREEMENT FOR THE USE OF HOME FUNDS AND REGULATORY AGREEMENT BETWEEN SAN LEANDRO SHELTER FOR WOMEN AND CHILDREN AND THE CITY OF SAN LEANDRO FOR BESSIE COLEMAN COURT AT ALAMEDA NAVAL AIR STATION AMENDMENT NO. 1 This Amendment is made and entered into this 19th day of April 1999, by and between the City of San Leandro,hereinafter referred to as City, and San Leandro Shelter for Women and Children, hereinafter referred to as Contractor. WITNESSETH: WHEREAS,the City and Contractor entered in the Contract for the Use of HOME Funds dated March 17, 1997 to fund predevelopment and construction monitoring expenses associated with the rehabilitation of fifty-three(53)housing units at the Naval Lodge,Naval Air Station, City of Alameda in Alameda County (hereinafter referred to as Contract); and WHEREAS, additional expenses to bring the rehabilitated units up to appropriate building standards have been identified; and WHEREAS,the Contractor is willing and able to perform the additional duties and render the additional services that have been identified and determined by the City to be necessary or appropriate for the welfare of residents of the City; and WHEREAS, City desires that such additional services and duties be provided by Contractor and Contractor agrees to perform such additional services and duties, as more particularly set forth below: NOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED as follows: 1. City has allocated an additional $100,000 in HOME funds to be expended under the Contract and used for additional expenses associated with the rehabilitation of fifty-three housing units at the Naval Air Station, City of Alameda. The terms and conditions for payment are those terms and conditions set forth in Exhibit B to the Contract. 2. The term of the Contract shall be extended to the 30th day of June, 2000, or when all contract terms have been completed. 3. Contractor shall make at least two units for permanent residents available to residents of the City of San Leandro. Such units shall be made available to other eligible residents only if no San Leandro residents occupy the units. 4. Except as specifically amended above, all terms of the Contract, including the exhibits thereto, shall remain in full force and effect.
