Lease Area Maps-Definitions <br /> "Reservation of Rights" <br /> Shows approximate area of reservation of real property interest by the Alameda Reuse <br /> • <br /> and Redevelopment Authority("ARRA")to permit access for the ARRA,the City of Alameda, <br /> its agents or assigns, including utility providers(collectively, the"City"), for maintenance and <br /> repair of existing utilities,which are obligations of the City(the"Maintenance Obligations"). • <br /> City shall use reasonable care in performing the Maintenance Obligations,and shall hold the <br /> ARRA and its tenants/subtenants("Lessee")harmless from damage caused by failure to perform <br /> the Maintenance Obligations. Use by the City of a Reservation of Rights area shall be limited to <br /> maintenance of existing utilities and shall not be extended to allow placement of additional <br /> utilities in the Reservation of Rights area. Utilities located in a Reservation of Rights area shall <br /> be relocated to the public right-of-way when major upgrading of utility systems occurs,at which <br /> time the ARRA shall quitclaim its interest in the Reservation of Rights area to the Lessee. Lessee <br /> may landscape over a Reservation of Rights area,to the extent such landscaping is consistent with <br /> the obligation of the City to maintain utilities within the Reservation of Rights area. <br /> "Reservation of Rights(Future Imp.)" <br /> Shows area of reservation of real property interest by the Alameda Reuse and <br /> Redevelopment Authority("ARRA")to permit access for the ARRA, the City of Alameda,its <br /> agents or assigns, including utility providers(collectively,the"City"), for contemplated future <br /> installation and maintenance of curbs,gutters,sidewalks,utilities,and landscaping in connection <br /> with construction or upgrading of streets and major upgrading of utility systems("Future <br /> Sidewalk and Utility Improvements"). City shall use reasonable care in siting and maintaining <br /> the Future Sidewalk and Utility Improvements,and shall hold the ARRA and its <br /> • <br /> tenants/subtenants("Lessee")harmless from damage caused by failure to maintain the Future <br /> Sidewalk and Utility Improvements.
