City, to prevent or enjoin the collection under this ordinance, or Part 1.6 of Division 2 of the <br />Revenue and Taxation Code, of any tax or any amount of tax required to be collected. <br />Section 2-19-165.Citizens Oversight Committee. <br />There shall be a five-person committee of members of the public to review and report on the <br />revenue and expenditure of funds from the tax adopted by this Chapter. Prior to the operative <br />date, the City Council shall adopt a resolution establishing the composition of the committee and <br />defining the scope of its responsibilities. Also prior to the operative date, the City Council shall <br />appoint at least a quorum of the members of the committee; the City Council shall complete the <br />appointment of members of the committee by the end of fiscal year 2015. <br />Section 2-19-170.Termination Date. <br />The authority to levy the tax imposed by this ordinance shall expire on the thirtieth (30th) <br />anniversary of the last day of the calendar quarter following the operative date.” <br />SECTION 2.ENVIRONMENTAL COMPLIANCE. <br />The findings for this ordinance in compliance with the California Environmental Quality Act <br />(“CEQA”) are the same as those set forth in the City’s Resolution calling for an election on this <br />Ordinance. The CEQA findings in that Resolution are incorporated herein by reference. <br />SECTION 3.SEVERABILITY. <br />If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Ordinance, <br />or its application to any person or circumstance, is for any reason held to be invalid or <br />unenforceable, such invalidity or unenforceability shall not affect the validity or enforceability of <br />the remaining sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases of <br />this Ordinance, or its application to any other person or circumstance. The City Council of the <br />City of San Leandro hereby declares that it would have adopted each section, subsection, <br />subdivision, paragraph, sentence, clause or phrase hereof, irrespective of the fact that any one or <br />more other sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases hereof <br />is declared invalid or unenforceable. <br />SECTION 4.EFFECTIVE DATE. <br />This ordinance relates to the levying and collecting of a City transactions and use tax and shall <br />take effect immediately.
