IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2014-072 <br /> RESOLUTION ACCEPTING THE ENGINEER'S REPORT FOR FISCAL YEAR 2014-15 <br /> FOR THE HERON BAY MAINTENANCE ASSESSMENT DISTRICT, <br /> ASSESSMENT DISTRICT NO. 96-3 <br /> WHEREAS, the City Council of the City of San Leandro,pursuant to the provisions of <br /> the San Leandro Municipal Code, Chapter 5, Title II (hereafter referred to as the "Code") did <br /> order the Engineer, Willdan Financial Services,to prepare and file a report in accordance with <br /> the Code in connection with the proposed levy and collection of assessments for the district <br /> known and designated as the Heron Bay Maintenance Assessment District(Assessment District <br /> No. 96-3) for the fiscal year commencing July 1, 2014 and ending June 30, 2015; and <br /> WHEREAS, the Engineer has prepared and filed with the City Clerk of the City of San <br /> Leandro and the City Clerk has presented to the City Council such report entitled "Engineer's <br /> Report, Heron Bay Maintenance Assessment District, Assessment District No. 96-3, Fiscal Year <br /> 2014/2015" (hereafter referred to as the "Report", attached hereto and made a part hereof); and <br /> WHEREAS,the City Council has carefully examined and reviewed the Report as <br /> presented, and is satisfied with each and all of the items and documents as set forth therein and <br /> finds that the levy has been assessed in accordance with the special benefits received from the <br /> improvements, operation,maintenance, and services to be performed, as set forth in said Report. <br /> NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br /> follows: <br /> That the City Council hereby approves the Engineer's Report for Fiscal Year 2014-15 for <br /> the Heron Bay Maintenance Assessment District, Assessment District No. 96-3, as filed. <br /> Introduced by Councilmember Cutter and passed and adopted this 7th day of July, 2014, <br /> by the following vote: <br /> Members of the Council: <br /> AYES: Councilmembers Cutter, Gregory, Lee, Prola, Souza;Mayor Cassidy (6) <br /> NOES: None (0) <br /> ABSENT: Councilmember Reed (1) <br /> ATTEST: n(WOUU ` 61.(k'JIL---' <br /> Marian Handa, City Clerk <br />
