<br /> <br />Section 4. Hours of Work <br /> <br /> A work week shall be computed as the number of hours customarily considered as a <br />full week's work in the classification and in the department in which the person is <br />employed. <br /> <br /> The setting of work hours is based upon the operational needs of the department. An <br />employee’s work hours may be changed based upon the operational needs of the <br />department. In the event an employee’s work schedule is to be changed; the <br />employee shall be given seven (7) working days advance notice. <br /> <br /> <br />Section 5. Overtime Compensation <br /> <br /> Except as otherwise noted, the City’s official work period is 12:00 a.m. Sunday through <br />11:59 p.m. Saturday. Overtime is authorized time of five (5) minutes or more worked in <br />excess of forty (40) hours in a designated seven (7) day work period in the <br />classification and/or in excess of eight (8) hours (or the regularly scheduled work day if <br />longer than (8) hours) in the department in which the person is employed. Unless <br />initiated/requested by an employee, no employee's scheduled work period will be <br />changed to avoid paying overtime. <br /> <br /> When first authorized by the department head and with approval of the City Manager, <br />overtime worked shall be paid at the rate of one and one-half (1½) times the hourly <br />rate based on the employee's monthly salary. For required call-out on a normal work <br />day, a minimum two (2) hours' pay at the overtime rate will be paid for the first such <br />call-out. For required call-out on a normal day off, a minimum two (2) hours' pay at the <br />overtime rate will be paid for each of the first two (2) such call-outs. It is understood <br />that a telephone call made to an employee during non-working hours which does not <br />result in a call out of that employee, shall not qualify for payment pursuant to this <br />section. This time off must be taken no later than the calendar year following the <br />calendar year in which it was accrued and at a time specifically approved by the <br />supervisor. Except as herein above, a full-time regular employee who is required to <br />work on a holiday at the direction of his/her department head, shall receive his/her pay <br />for the holiday plus one and one-half (1½) times his/her regular pay for the time <br />worked. <br /> <br /> An employee may elect to take compensatory time off in an amount equal to one and <br />one-half (1½) times the overtime worked in lieu of pay. Compensatory time may be <br />used, and replaced, without regard to frequency of use, as long as the account balance <br />does not exceed 80 hours. <br /> <br /> In the event an employee is ordered by a magistrate to appear in court and does <br />appear on a day during which the employee has called in sick, the employee will be <br />paid overtime at the rate listed for court appearance, except that employees working <br />the day shift shall not be paid overtime, but the hours spent at the court appearance <br />shall not be deducted from his/her accumulated sick leave hours. <br /> <br />2 <br />San Leandro Confidential Employees Compensation Plan
