AMENDMENT NO. 1 TO NON-PROFESSIONAL SERVICES AGREEMENT BETWEEN <br /> THE CITY OF SAN LEANDRO AND PACHECO BROTHERS GARDENING, INC. <br /> FOR CITYWIDE LANDSCAPE MAINTENANCE AND WEED ABATEMENT IN CITY RIGHT-OF-WAYS <br /> This Amendment No. 1 ("Amendment") is made by and between the City of San Leandro ("City") <br /> and Pacheco Brothers Gardening, Inc. ("Contractor") (together sometimes referred to as the "Parties") as of <br /> July 1, 2014, and amends that certain Non-Professional Services Agreement("Agreement")dated February <br /> 1, 2010, between the Parties. <br /> WHEREAS, City and Contractor have executed the Agreement, pursuant to which Consultant has <br /> provided certain consulting services to City with regard to landscaping maintenance and weed abatement <br /> in medians and other City right-of ways; and <br /> WHEREAS, the Parties desire to amend the Agreement to allow for work to be performed four(4) <br /> days per week instead of five (5)days per week as noted in the NPSA. <br /> NOW THEREFORE, for good and valuable consideration, the sufficiency of which is hereby <br /> acknowledged, the Parties hereby agree to amend the Agreement as follows: <br /> 1. Section 1.1 of the Agreement entitled "Term of Services" is hereby amended to extend the <br /> term from July 1, 2014, to June 30, 2a'l$; and <br /> 22IS <br /> 2. Section 2 of the Agreement entitled "Compensation" is hereby amended to pay Contractor a <br /> sum not to exceed $125,160.24 which includes a 2.2% CPI adjustment on the monthly service ($10,430.02 <br /> per month)for the fiscal year; and <br /> 3. Exhibit A of the Agreement entitled "Scope of Services" is hereby amended to read: <br /> The Contractor shall conduct all operations four(4)days per week during the hours of <br /> 7:00 a.m. and 5:00 p.m. on weekdays mutually agreed upon between the City and Contractor as <br /> noted in the weekly schedule provided by the Contractor. Contractor may not work on any Federal, <br /> State, or local holidays. <br /> 4.
