D 0 A FV <br />element which is not located solely within one Parcel and which the Lessees d e <br />Project -Serving Component, except that any utility equipment which is part of a discrete and <br />complete system servicing only one Lessee Parcel, or a part thereof, shall not be included. The <br />Roof of the Building is included in this definition. <br />(ccc) "Property" means that certain real property described in Exhibit A and as <br />further described in Recital B. <br />(ddd) "Reimbursement Assessment" has the meaning given in Section 4.6(b). <br />(eee) "Reimbursement Expense" has the meaning given in Section 4.6(a). <br />(fff) "Roof' means the waterproof membrane on the uppermost surface of the <br />Building which is exposed to the elements together with the load bearing structure that supports <br />such membrane. The Roof is contained in the Family Parcel and is a Project -Serving <br />Component. <br />(ggg) "Special Joint Expenses Assessment" has the meaning given in <br />Section 4.5. <br />(hhh) "Users" means a Lessee's employees, tenants, lessees, guests, licensees, <br />contractors and subcontractors. <br />1.2 Exhibits. The following exhibits are attached to and incorporated into this <br />Declaration: <br />Exhibit A Legal Description of the Property <br />Exhibit B Parcel Map <br />ARTICLE 2 <br />DIVISION OF PROPERTY, GRANT OF EASEMENTS, AND <br />MAINTENANCE <br />2.1 General Description of Property. <br />(a) General Boundaries. Each of the Parcels has the boundaries shown on the <br />Map. <br />(b) BART Parking Parcel, Phase II Parking Parcel, Family Parcel, and <br />Parking Garage. The BART Parking Parcel, Phase II Parking Parcel, and Family Parcel will <br />contain the Parking Garage. The initial construction of the Parking Garage on each Lessee <br />Parcel will be accomplished by the BART Parking Parcel Lessee, the Phase II Parking Parcel <br />Lessee, and Family Parcel Lessee pursuant to separate construction contracts pertaining to the <br />portion of the Parking Garage on each Lessee Parcel. <br />(c) Family Parcel and Family Development.
