Sewer Lateral shall mean the piping OF uits used to <br />convey sewer wastewater from within a building or structure and nonneGtiRg the <br />building OF StFU Wre to a public or private sewerage collection, disposal and treatment <br />system. See Building Sewer, Private Sewer Lateral. <br />Sewerage <br />appurtenanGes owned or operated Cityr <br />• <br />(bd) Significant Industrial User. Significant Industrial User shall mean: <br />standards; <br />(1) An -y -Industrial Users subject to federal categorical pretreatment <br />(2) Any other Industrial User that: <br />Discharges to the POTW an average of twenty-five thousand <br />(25,000) gallons or more of process wastewater per day= <br />Contributes process wastewater that makesing up five percent <br />(5%) or more of the average dry weather hydraulic or organic <br />capacity of the POTW treatment plant; or - <br />Is designated as such by the Manage Control Authority on the <br />basis that it the Industrial User has a reasonable potential to <br />adversely eaffect the POTW's operation or to violate a pretreatment <br />standard or requirement. <br />The term is further defined at 40 CFR 403.3(v). <br />(be) Significant Noncompliance. Significant Noncompliance shall mean as <br />Significant Industrial User's is -in violation of pretreatment standards under one or more <br />meeting any of the following criteria or an Industrial User's violation of pretreatment <br />standards meeting criteria (3), (4), or (8): <br />(1) Chronic violations of wastewater discharge limits, defined herein as <br />those in which sixty-six percent (66%) or more of all of the measurements taken during <br />a six (6) month period exceed (by any magnitude) the daily maximi lin limit or the <br />average limit a numeric Pretreatment Stardard or Requirement for the same <br />pollutant parameter, including instantaneous limits, as defined by 40 CFR 403.3(1); <br />(2) Technical Review Criteria (TRC) violations, defined herein as those <br />in which thirty-three percent (33%) or more of all of the measurements taken for eaGh <br />the same pollutant parametertaken during a six (6) month period equal or exceed the <br />9 <br />
