IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2014-119 <br /> RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN <br /> AMENDMENT TO LEGAL SERVICES AGREEMENT WITH <br /> JARVIS,FAY, DOPORTO,AND GIBSON, LLP FOR LEGAL REPRESENTATION <br /> ASSOCIATED WITH THE ILMBERGER ET AL. V. CITY OF SAN LEANDRO LITIGATION <br /> WHEREAS,the City in accordance with its purchasing provisions has identified Jarvis, <br /> Fay, Doporto, and Gibson,LLP to continue to provide legal representation associated with the <br /> Ilmberger et al. v. City of San Leandro case; and <br /> WHEREAS,the City wishes to enter into an amendment to the agreement with Jarvis, Fay, <br /> Doporto, and Gibson,LLP for said work; and <br /> WHEREAS,the City Council is familiar with the terms of the agreement amendment; and <br /> WHEREAS,the City Manager recommends approval of said agreement amendment. <br /> NOW, THEREFORE,the City Council of the City of San Leandro does RESOLVE as <br /> follows: <br /> 1. That said amendment to the agreement in an amount not to exceed$110,000.00 is <br /> hereby approved; and <br /> 2. That the terms of the agreement will be memorialized in writing by the City <br /> Manager, subject to the approval of the City Attorney; and <br /> 3. That the City Manager is authorized to execute said agreement amendment; and <br /> 4. That an original executed agreement amendment shall be provided to the City <br /> Clerk, shall be attached, and made a part of this resolution. <br /> Introduced by Councilmember Souza and passed and adopted this 3rd day of November, <br /> 2014, by the following vote: <br /> Members of the Council: <br /> AYES: Councilmembers Cutter, Lee, Prola, Reed, Souza; Mayor Cassidy (6) <br /> NOES: None (0) <br /> ABSENT: Councilmember Gregory (1) <br /> ATTEST: lA✓WLAA' <br /> Marian Handa, City Clerk <br />
