City, to prevent or enjoin the collection under this ordinance, or Part 1.6 of Division 2 of the <br /> Revenue and Taxation Code, of any tax or any amount of tax required to be collected. <br /> Section 2-19-165. Citizens Oversight Committee. <br /> There shall be a five-person committee of members of the public to review and report on the <br /> revenue and expenditure of funds from the tax adopted by this Chapter. Prior to the operative <br /> date, the City Council shall adopt a resolution establishing the composition of the committee and <br /> defining the scope of its responsibilities. Also prior to the operative date, the City Council shall <br /> appoint at least a quorum of the members of the committee; the City Council shall complete the <br /> appointment of members of the committee by the end of fiscal year 2015. <br /> Section 2-19-170. Termination Date. <br /> The authority to levy the tax imposed by this ordinance shall expire on the thirtieth (30th) <br /> anniversary of the last day of the calendar quarter following the operative date." <br /> SECTION 2. ENVIRONMENTAL COMPLIANCE. <br /> The findings for this ordinance in compliance with the California Environmental Quality Act <br /> ("CEQA") are the same as those set forth in the City's Resolution calling for an election on this <br /> Ordinance. The CEQA findings in that Resolution are incorporated herein by reference. <br /> SECTION 3. SEVERABILITY. <br /> If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Ordinance, <br /> or its application to any person or circumstance, is for any reason held to be invalid or <br /> unenforceable, such invalidity or unenforceability shall not affect the validity or enforceability of <br /> the remaining sections, subsections, subdivisions,paragraphs, sentences, clauses or phrases of <br /> this Ordinance, or its application to any other person or circumstance. The City Council of the <br /> City of San Leandro hereby declares that it would have adopted each section, subsection, <br /> subdivision, paragraph, sentence, clause or phrase hereof, irrespective of the fact that any one or <br /> more other sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases hereof <br /> is declared invalid or unenforceable. <br /> SECTION 4. EFFECTIVE DATE. <br /> This ordinance relates to the levying and collecting of a City transactions and use tax and shall <br /> take effect immediately. <br /> INTRODUCED by Councilmember Prola on this 7th day of July, 2014, and passed to <br /> print and approved by the following called vote: <br /> Members of the Council: <br /> AYES: Councilmembers Cutter, Gregory, Lee, Prola, Souza; Mayor Cassidy (6) <br /> NOES: None (0) <br /> ABSENT: Councilmember Reed (1) <br /> ORDINANCE NO.2014-012 7 <br />
