City of San Leandro Meeting Date: January 5, 2015 Resolution - Council File Number: 14-567 Agenda Section: CONSENT CALENDAR Agenda Number: TO: City Council FROM: Chris Zapata City Manager BY: Lianne Marshall Assistant City Manager FINANCE REVIEW: David Baum Finance Director TITLE: RESOLUTION Approving a Fiber License Agreement with San Leandro Unified School District (SLUSD) for Exclusive Access to and Use of City-owned fiber optic strands WHEREAS, the City of San Leandro owns fiber strands within the fiber optic cable facility commonly known as the San Leandro Dark Fiber Loop (the "Fiber System"), as evidenced by a current agreement between the City and San Leandro Dark Fiber, LLC (the "License Agreement"); and WHEREAS, the SLUSD wishes to access and use specific City-owned fiber optic strands along various portions of the Fiber System subject to the terms and conditions set forth in this Agreement; and WHEREAS, this request fulfills various elements of the Economic Development Plan and General Plan previously adopted by the City Council, in addition to adopted City Council Goals; and WHEREAS, adoption of this agreement would result in numerous community benefits resulting from the ability of students and teachers to access a 10 GBPS internet speed connection, the fastest commercial connection available anywhere in the United States; and WHEREAS, an agreement between the City of San Leandro and San Leandro Unified School District, a copy of which is attached, has been presented to the City Council; and WHEREAS, the City Council is familiar with the contents thereof; and WHEREAS, the City Manager recommends approval of said agreement.
