File Number: 15-015 <br />TO: City Council <br />FROM: Chris Zapata <br />City Manager <br />City of San Leandro <br />Meeting Date: January 20, 2015 <br />BY: Lianne Marshall <br />Assistant City Manager <br />Staff Report <br />Agenda Section: CONSENT CALENDAR <br />Agenda Number: 8.G. <br />FINANCE REVIEW: Not Applicable <br />TITLE: Staff Report for a Resolution Amending Section 6.4.100 of the San Leandro <br />Administrative Code to Increase the Subpoena Fee for Personal Appearance <br />of City Employees <br />SUMMARY AND RECOMMENDATIONS <br />Staff recommends that the City Council adopt a resolution amending the City's Fee Schedule <br />to increase the subpoena fee for the personal appearance of City employees from $150 to <br />$275 to conform with a change to state law. <br />BACKGROUND <br />Assembly Bill 2727, effective January 1, 2015, amended California Government Code Section <br />68096.1 to increase the witness fee for local agency employees, from $150 to $275 for each <br />day that the employee is required to be in attendance at the proceeding pursuant to the <br />subpoena. Because the fee is listed in the City's Fee Schedule, the Fee Schedule must be <br />amended to reflect the increase. <br />Current Agency Policies <br />The City's Fee Schedule is codified in Title 6, Chapter 4 of the San Leandro Administrative <br />Code. <br />Previous Actions <br />In 2013, pursuant to the passage of AB 2612, the City Council approved an amendment to the <br />Fee Schedule to increase the subpoena fee for the personal appearance of police officers <br />from $150 to $275 to conform with the change to state law. <br />Fiscal Impacts <br />City of San Leandro Page 1 Printed on 1/13/2015 <br />
