DRAFT COMMUNITY WORKFORCE AGREEMENT <br />For the City of San Leandro <br />This Agreement is made and entered into this day of ('effective <br />Date'), by and between the City of San Leandro ("City") together with other contractors and/or <br />sub -contractors, who shall become parties to this Agreement by signing the 'Agreement to be <br />Bound" (Attachment A), and the Local Unions signatory hereto and the Alameda County Building <br />& Construction Trades Council and its affiliated local unions who have executed thisAgreement. <br />PURPOSE <br />The purpose of this Agreement is to support the efforts of the City to increase <br />employment opportunities for workers who reside in San Leandro, to help increase training and <br />employment opportunities for the City's students in the construction trades through apprenticeship <br />and pre -apprentice programs as the students graduate from the City's schools, to promote <br />efficiency of construction operations performed for and within the City of San Leandro and to <br />provide for peaceful settlement of labor disputes and grievances without strikes or lockouts, thereby <br />promoting the public interest in assuring the timely and economical completion oftheprojects. <br />RECITALS <br />WHEREAS, the successful completion of the City's construction projects is of the utmost <br />importance to the City of San Leandro; and <br />WHEREAS, the interests of the general public, the City, the Unions and Contractor(s) <br />would be best served if the construction work proceeded in an orderly manner without disruption <br />because of strikes, sympathy strikes, work stoppages, picketing, lockouts, slowdowns or other <br />interferences with work; and <br />WHEREAS, the Contractor(s) and the Unions desire to mutually establish and stabilize <br />wages, hours and working conditions for the workers employed on construction work for and <br />within the City of San Leandro by the Contractor(s), and further, to encourage close cooperation <br />among the Contractor(s) and the Union(s) to the end that a satisfactory, continuous and harmonious <br />relationship will exist among the parties to this Agreement; and <br />WHEREAS, contracts for construction work within the City of San Leandro will be awarded <br />in accordance with the applicable provisions of the Charter of the City of San Leandro, the <br />California State Public Contract Code and the Labor Code, including but not limited to requiring <br />competitive bidding and prevailingwages; and <br />WHEREAS, the City of San Leandro has the absolute right to select the lowest <br />responsive and responsible bidder for the award of the construction contracts on the Projects; and <br />WHEREAS, the parties signatory to this Agreement pledge their full good faith and trust to <br />work towards a mutually satisfactory completion of the Proj ects; <br />NOW, THEREFORE, IT IS AGREED BETWEEN AND AMONG THE PARTIES <br />HERETO,AS FOLLOWS: <br />1 <br />
