F. Heron Bay HOA requested that the City rescind its Zoning Official's February <br /> 3, 2014,approval of the Four Turbine Project. The Zoning Official rescinded her approval <br /> on September 16,2014. <br /> F. Heron Bay HOA filed a request to dismiss the Four Turbine Action on <br /> October 1,2014 and dismissal was entered by the Court on October 3, 2014. <br /> G. On October 8,2014, Heron Bay HOA filed a Memorandum of Costs for a total <br /> of$674.95. <br /> H. On October 27,2014,the City filed a motion to strike Heron Bay HOA's <br /> memorandum of costs. The hearing on the City's motion to strike was originally scheduled <br /> to be heard on December 4,2014. <br /> I. The parties subsequently began settlement negotiations to resolve both Heron <br /> Bay HOA's memorandum of costs and Heron Bay HOA's pending,but not yet filed,motion <br /> for attorneys' fees. To further those negotiations,the Parties entered into a stipulation <br /> extending the time for filing a motion for attorneys' fees to January 30, 2015, and moving the <br /> hearing on the City's motion to strike costs to February 5,2015. <br /> J. The parties have successfully completed settlement negotiations and now <br /> desire to resolve,fully and completely,Heron Bay HOA's claims for costs and attorney's <br /> fees arising out of the Four Turbine Action as follows: <br /> AGREEMENT <br /> NOW, THEREFORE, for good and valuable consideration,including the <br /> covenants and agreements set forth herein,the receipt and sufficiency of which is hereby <br /> acknowledged, each of the Parties hereby agrees as follows: <br /> 2 <br /> 358521.1 <br />
