1 EAST BAY DISCHARGERS AUTHORITY <br /> 2 <br /> 3T4RD FOURTH AMENDED JOINT EXERCISE OF POWERS <br /> 4 <br /> AGREEMENT <br /> 5 <br /> 6 <br /> 7 THIS FOURTH AMENDED JOINT EXERCISE OF POWERS AGREEMENT, <br /> 8 <br /> dated for convenience as of February 1-5, 2007 October f 1, 2014, is made and <br /> 9 entered into by and between the CITY OF HAYWARD, a municipal corporation, <br /> 10 hereinafter referred to as "Hayward"; CITY OF SAN LEANDRO, a municipal <br /> 11 corporation, hereinafter referred to as "San Leandro"; ORO LOMA SANITARY <br /> 12 DISTRICT, a public corporation, hereinafter referred to as "Oro Loma"; CASTRO <br /> 13 VALLEY SANITARY DISTRICT, a public corporation, hereinafter referred to as "Castro <br /> 14 Valley"; and UNION SANITARY DISTRICT, a public corporation, hereinafter referred to <br /> 15 as "Union"; each duly organized and existing in the County of Alameda under the <br /> 16 constitution and laws of the State of California, and amends that SeEeed—Third <br /> 17 Amended Joint Exercise of Powers Agreement dated February 1415, 19862007, duly <br /> 18 entered into by said Agencies, as follows: <br /> 19 <br /> 20 WITNESSETH: <br /> 21 <br /> 22 WHEREAS, each of the Agencies hereto has power to plan for, acquire, <br /> 23 construct, maintain, manage, operate, and control facilities for the collection, <br /> 24 <br /> transmission, treatment, reclamation, sale and disposal of wastewater; and the <br /> 25 <br /> Agencies propose by this Agreement to exercise said powers jointly for the purpose of <br /> 26 <br /> 27 providing for the more efficient disposal of the wastewater produced in each Agency, all <br /> 28 to the economic and financial advantage of each Agency and otherwise for the benefit <br /> 29 of each Agency; and each of the Agencies is willing to plan with the other Agencies for <br /> 30 joint wastewater facilities which will protect all of the Agencies; <br /> 31 <br /> 32 <br /> -1- <br /> 2336705.4 <br />
