IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2015-095 <br /> RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br /> 12TH AMENDMENT TO THE FRANCHISE AGREEMENT BETWEEN THE <br /> CITY OF SAN LEANDRO AND ALAMEDA COUNTY INDUSTRIES, INC. <br /> WHEREAS, the City of San Leandro ("City") and Alameda County Industries, <br /> Inc.("ACI"), executed that certain Franchise Agreement for Solid Waste, Recyclables, and Green <br /> Waste Services, dated February 1, 2000 ("Franchise Agreement"); and <br /> WHEREAS, the Franchise Agreement has been amended by the City and ACI from time <br /> to time; and <br /> WHEREAS, a 12th Amendment to the Franchise Agreement between the City of San <br /> Leandro and Alameda County Industries (ACI), Inc., a copy of which is attached, is been <br /> presented to this City Council; and <br /> WHEREAS, the City Council is familiar with the contents thereof; and <br /> WHEREAS, the City Manager recommends approval of said agreement; <br /> WHEREAS, pursuant to the letter amendment, ACI will be authorized to implement an <br /> 8.49%rate increase for all rates effective August 1, 2015. <br /> NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br /> follows: <br /> That said 12th Amendment is hereby approved and execution by the City Manager is <br /> hereby authorized. <br /> Introduced by Councilmember Thomas and passed and adopted this 18th day of May, <br /> 2015, by the following vote: <br /> Members of the Council: <br /> AYES: Councilmembers Cox, Lee, Lopez, Prola, Reed, Thomas; Mayor Cutter (7) <br /> NOES: None (0) <br /> ABSENT: None (0) <br /> ATTEST: <br /> Tamika Greenwood, City Clerk <br />
