EXHIBIT A <br /> SCOPE OF SERVICES <br /> Project Description: <br /> This project involves the purchase and installation of 7 units of quad eLockers (28 spaces), and its <br /> electronic controller with software and latching mechanism at San Leandro BART Station. The City has <br /> secured funds from the Transportation Fund for Clean Air Program from Bay Area Air Quality Management <br /> District(BAAQMD)for the project. Upon completion of the installation, the 28 eLockers will be transferred to <br /> BART. From thereafter, BART will power and maintain the eLockers. <br /> Scope of Services: <br /> Furnish, deliver, and install 7 units of quad eLockers per Technical Specifications(Attachment 1) at San <br /> Leandro BART Station (1401 San Leandro Boulevard, San Leandro). The locker footprint will be marked on <br /> the ground by the City prior to delivery and installation. <br /> Provide Limited Product Warranty and BikeLink Software per Attachment 2 and 3, respectively. <br /> Technical Specifications –Attachment 1 <br /> Limited Product Warranty –Attachment 2 <br /> BikeLink Software License –Attachment 3 <br /> Hours of Work <br /> Monday- Friday, 8:00 am to 6:00 p.m. excluding City Holidays listed here <br /> http://www.sanleandro.org/contact/holidays.asp. <br /> Prosecution of Work <br /> The Contractor shall not begin work until the Notice to Proceed is issued by the City. Contractor shall <br /> diligently prosecute the work to completion before the expiration of 70 working days. <br /> The City shall begin charging working days on the fifth working day following the date of issuance of the <br /> Notice to Proceed. <br /> Liquidated Damages <br /> By execution of the Agreement, the City and the Contractor agree that it will be difficult or impossible to <br /> determine the actual damage that the City will sustain in the event of the Contractor's failure to fully perform <br /> the work or to fully perform all of the Contractor's obligations that have accrued pursuant to the agreement <br /> by the time for completion. <br /> Accordingly, the City and the Contractor agree in accordance with California Government Code Section <br /> 53069.85 that the Contractor will forfeit and pay to the City liquidated damages in the sum of$250.00 per <br /> Non-Professional Services Agreement between SL BART Bike eLocker <br /> City of San Leandro and eLock Technologies LLC—Exhibit A <br />
