IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 99 - 82 (1120) RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO ELECTING TO RECEIVE INCREMENTAL PROPERTY TAX REVENUES AS PROVIDED FOR BY SECTION 33676 OF THE CALIFORNIA HEALTH AND SAFETY CODE FOR THE WEST SAN LEANDRO/MACARTHUR BOULEVARD REDEVELOPMENT PROJECT AREA WHEREAS, Section 33676 of the California Health and Safety Code provides for the City of San Leandro, an affected taxing agency, to make certain elections regarding the receipt of incremental property tax revenues to be derived from a proposed redevelopment area; and WHEREAS, the City of San Leandro and the Redevelopment Agency for the City of San Leandro are considering adopting a Redevelopment Plan and have designated a project area for the Redevelopment Plan and said Plan provides for tax increment financing pursuant to Section 33670 of the California Health and Safety Code; and WHEREAS, Section 33676 of the California Health and Safety Code provides for said election to be made by the City of San Leandro prior to the City and Redevelopment Agency adopting the Plan for the Redevelopment Plan; and NOW, THEREFORE, the San Leandro City Council does hereby resolve as follows: The City of San Leandro elects to receive in addition to that portion of taxes allocated to the City pursuant to Section 33670, that portion of property tax revenues that would otherwise be allocated to the Redevelopment Agency of the City of San Leandro pursuant to subdivision (b) of Section 33670 of the California Health and Safety Code for the Redevelopment Plan that are attributable to increases in the rate of tax imposed for the benefit of the City of San Leandro which levy occurs in the tax year in which the ordinance adopting the Redevelopment Plan for the West San Leandro/West MacArthur Boulevard Redevelopment Project becomes effective. 1
