IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2015-131 RESOLUTION TO APPROVE FINDING TRIACTIVE AMERICA, A SOLE SOURCE SUPPLIER FOR CITY PARKS EXERCISE EQUIPMENT WHEREAS,the Public Works Department requests that the City find that equipment designed,made and/or supplied by TriActive America is currently in use in several City parks, and that for the following reasons, should be the City's sole source supplier of park exercise equipment for renovation and/or new park construction; and WHEREAS, it is evident to the Department of Public Works that TriActive America equipment currently in use is more durable, is more cost-effective and time-saving, especially with regards to the procurement of replacement parts, and TriActive America warranty and customer service are excellent; and WHEREAS,TriActive America provides a variety of customized and scalable product lines, allowing for each park exercise apparatus to have unique characteristics,while maintaining the specific benefits described above; and WHEREAS,TriActive America products are 'Made in America' and are available from local authorized dealers; and WHEREAS,finding TriActive America a sole source provider for parks playground equipment is in the best interests of the City because it makes maintenance more efficient since TriActive America is already in use in other parks that allows for useful interchangeability of parts and uniformity of procedures for maintenance and repair activities,which thereby reduces down time; and WHEREAS,higher availability of spare parts, and familiarity with TriActive America's warranty and customer service systems and procedures saves costs by causing greater efficiency for maintenance staff to complete repairs,thereby maximizing use; and WHEREAS,the City Manager recommends that the City Council find that it's in the best interests of the City to waive the competitive bidding requirements as they pertain to the procurement of park exercise equipment as provided for in Section 1-6-315 of the San Leandro Municipal Code, and on the basis of the recitals above, find that going forward TriActive America should be the sole source supplier to the City of outdoor exercise equipment for renovations and new constructions of City park play structures. NOW, THEREFORE,the City Council of the City of San Leandro does RESOLVE as follows: That the above recitals are true and correct, and the City Council finds that for all of the aforementioned reasons, TriActive America shall be the sole source provider for outdoor exercise equipment in City parks.
