(Applicant) <br /> Christina Jackson,Prologis Targeted US Logistics Fund LP (Property Owner) <br /> THIS AGREEMENT is entered into by and between the CITY OF SAN LEANDRO, a municipal <br /> corporation, hereinafter referred to as "City," and Daryl Wise, St. George Warehouse, Inc., a <br /> California corporation, hereinafter referred to as "Applicant" and Christina Jackson, Prologis <br /> Targeted US Logistics Fund LP,a Limited Partnership,hereinafter referred to as"Property Owner". <br /> Applicant applied for and received Fence Modification approval to erect a 10-foot tall black iron <br /> picket fence with associated 48-inch wide pedestrian entry gate(with black metal infill)and 36-foot <br /> wide manual vehicular access gates (with black metal infill) within the required front yard setback <br /> where three feet is the maximum fence height permitted. Approval is also granted for the <br /> installation of an eight-foot tall chain link fence with black vinyl finish and two feet of black(vinyl <br /> coated or painted) barbed wire (four strands) above for a cumulative height of 10-feet within 300- <br /> feet of a public street frontage with visual accessibility. Both the 10-foot tall black iron picket fence <br /> and eight-foot tall chain link fence with black vinyl finish and two feet of black (vinyl coated or <br /> painted) barbed wire above exceed the maximum eight-foot tall fencing height limitation in the <br /> industrial district at 1500 Doolittle Drive; Alameda County Assessor's Parcel Numbers 77A-680-7- <br /> 7, 77A-680-2-10 and 77A-680-2-11. <br /> NOW, THEREFORE, pursuant to the applicable provisions of the Zoning Code, it is <br /> mutually agreed as follows: <br /> 1. Applicant/Property Owner agree to comply with the Conditions of Approval adopted by <br /> the City of San Leandro Zoning Enforcement Official, more specifically described in the list of <br /> Conditions of Approval, attached hereto, and as described in the exhibits on file in the Community <br /> Development Department,all of which are incorporated herein by this reference. <br /> 2.
