MTC/City of San Leandro <br /> Bay Fair BART Transit Village Specific Plan EIR Funding Agreement <br /> Page 2 <br /> Subject only to duly executed amendments, it is expressly understood and agreed that in no event <br /> shall the total compensation to be paid under the Agreement exceed the sum of four hundred and <br /> forty thousand dollars ($440,000). <br /> The Agreement is funded in whole, or in part, by Surface Transportation Program(STP) funds <br /> allocated to MTC by the Federal Highway Administration, funds from which have been awarded <br /> to RECIPIENT by MTC, and the provisions in Attachment C, Terms and Conditions, and <br /> Attachment D, Fair Employment Practices Addendum, and Attachment E,Nondiscrimination <br /> Assurances, are hereby incorporated by reference. To the extent that they conflict with any of <br /> the above provisions, they supersede such provisions. <br /> Performance shall begin on December 15, 2014 , and be completed by June 30, 2017, unless <br /> MTC terminates this agreement earlier as provided in Article 3, Termination, of Attachment C. <br /> If you agree,please sign both copies of this letter in the space provided below and return one to <br /> us.
