The City, serving in its capacity as the Successor Agency to the former City of <br /> San Leandro Redevelopment Agency, and Innisfree Ventures II ("Developer") entered into <br /> a Disposition and Development Agreement (the "DDA") dated July 20, 2012 concerning the <br /> redevelopment of 1550 East 14th Street, San Leandro, California, (APN 077 0540 009 00). <br /> B. As part of the redevelopment of the site, the Developer split the parcel into <br /> three separate parcels Parcel A, Parcel B and Parcel C as detailed in parcel map 10227 <br /> attached. <br /> C. Pursuant to Section 4.13 of the DDA, the City, by written request of the <br /> developer, is required to issue a Certificate of Completion for the Project after construction <br /> has been completed. The Certificate of Completion shall be conclusive evidence that the <br /> Developer has satisfied its obligations regarding the development of the Property. <br /> D. On November 14, 2014, the City determined that the development of Parcel B <br /> had been satisfactorily completed in accordance with the DDA and issued a partial <br /> Certification of Completion. <br /> E. The City determines that the development of Parcels A and C has been <br /> satisfactorily completed in accordance with the DDA. <br /> NOW, THEREFORE, City hereby certifies as follows: <br /> 1. Development of Parcels A and C has been satisfactorily completed in <br /> conformance with the DDA. <br /> 2. All use and maintenance covenants contained in the DDA shall remain in <br /> effect and enforceable in accordance with the DDA. <br /> 3. Nothing contained in this instrument shall modify any provisions of the DDA <br /> or any other document executed in connection therewith. <br /> 1180351-2 1 <br />
