<br />Staff proposes to change the discretionary approval process for “Day Care, General” from a
<br />Conditional Use Permit to Administrative Review in the RO, RS, RD, and RM Residential
<br />Districts (Sections 2-504, 2-506, 2-508, and 2-510) to reduce the amount of local regulation
<br />that these types of uses are subject to, since they serve an important community need. The
<br />Administrative Review process will still provide staff with a sufficient amount of review to
<br />ensure land use compatibility with these types of uses in residential districts.
<br />Home Occupations
<br />Staff had proposed changing wording in Section 2-514 C.1 of Article 5 of the Code to clarify
<br />that customers are not allowed to come to the applicant’s address in conjunction with a home
<br />occupation in order to reduce traffic and other potential impacts to a residential neighborhood.
<br />However, both the Board of Zoning Adjustments and the Planning Commission had concerns
<br />with the proposed new wording, so it has been removed from the proposed changes.
<br />Article 6, Commercial and Professional Districts
<br />Day Care, Limited
<br />Staff proposes to change the discretionary approval process for “Day Care, Limited” from a
<br />Conditional Use Permit to Administrative Review in the SA-2 District (Section 2-630) to reduce
<br />the amount of local regulation that these types of uses are subject to, since they serve an
<br />important community need. The Administrative Review process will still provide staff with a
<br />sufficient amount of review to ensure land use compatibility with these types of uses in the
<br />affected commercial district.

<br />DA-2, DA-3, DA-4, DA-5, and DA-6 Districts (Sections 2-604, 2-606, 2-614, 2-618, 2-628,
<br />2-630, 2-636, 2-638, 2-640, 2-642, 2-644, and 2-646) to reduce the amount of local regulation
<br />that these types of uses are subject to, since they serve an important community need. The
<br />Administrative Review process will still provide staff with a sufficient amount of review to
<br />ensure land use compatibility with these types of uses in the affected commercial districts.
<br />Industry, Custom
<br />Staff proposes to add “Industry, Custom” as a conditionally-permitted use in the DA-2, DA-3,
<br />DA-4, DA-5 and DA-6 Downtown Area Districts (Sections 2-638, 2-640, 2-642, 2-644, and
<br />2-646) to keep up with technological advancements, such as light- industrial applications like
<br />3-D printing that have few land use impacts and could be appropriate in certain commercial
<br />districts. The Conditional Use Permit process will provide staff with a sufficient amount of
<br />review to ensure land use compatibility with these types of uses in the affected commercial
<br />districts.
<br />Home Improvement and Interior Decoration
<br />Staff proposes to add Home Improvement and Interior Decoration as a conditionally-permitted
<br />use in the DA-3, DA-4, DA-5 and DA-6 Districts (Sections 2-640, 2-642, 2-644 and 2-646) to
<br />allow more flexibility in the code for small design studios, hardware stores, lighting and fixture
<br />stores and paint stores that could serve higher density uses. The Conditional Use Permit
