MITCIIELL ENGLANDER <br />1.os ANG 1:1P.s CITY COE:\c1LM[t,trtrit, TWE L FT I1 1)ISTItICT <br />July 24, 2015 <br />President Stephany Aguilar <br />League of California Cities <br />1400 K Street Suite 400 <br />Sacramento, CA 95814 <br />Fax: (916) 658-8240 <br />Re: A RESOLUTION OF THE LEAGUE OF CALIFORNIA CI'T'IES CALLING FOR <br />LEGISLATION TO PRESERVE THERAPEUTIC ENVIRONNIENTS FOR GROUP HOMES AND <br />AVOID IMPAC'T'S OF OVERCONCENTRATION OF ALCOHOL AND DRUG ABUSE; <br />RECOVERY AND TREATMENT FACILITIES IN RESIDENTIAL NEIGHBORHOODS <br />Dear President Aguilar, <br />1, Los Angeles City Councilmember Mitchell Englander, wish to support the League of California Cities <br />resolution for legislation to preserve therapeutic environments for group homes and avoid impacts of <br />overconcentration of alcohol and drug abuse recovery and treatment facilities in residential <br />neighborhoods to be adopted on October 2, 2015 at the Annual League of California Cities Conference <br />in San Jose, California. <br />In the interest of continuing local control, land use and planning and home rule, we believe the Governor <br />and Legislature should respect the individuals' legal rights. The California Fair Employment and <br />Housing Act includes legal protection against discrimination against persons with disabilities through <br />zoning laws, denials of use permits, and other actions authorized under the Planning and Zoning Law; <br />and the Americans with Disabilities Act requires public entities to make reasonable accommodations in <br />policies, practices, or procedures to avoid discrimination on the basis of a disability. There is no <br />provision in State law that allows for the consideration of the impact of alcoholism or drug abuse <br />recovery or treatment facilities on single-family neighborhoods or the overconcentration of these <br />facilities as there is for residential group home facilities. <br />This resolution respectfully points out that community concern could be addressed if state agencies <br />communicated and collaborated more with local government.
