File Number: 15-535 <br />WHEREAS, the Planning Commission held a noticed public hearing on the proposed <br />amendments on August 20, 2015, then adopted Resolution No. 2015-03, incorporated herein <br />by reference, recommending that the City Council adopt the amendments; and <br />WHEREAS, a staff report dated September 21, 2015 and incorporated herein by <br />reference, analyzed the proposed CEQA exemption and the proposed Zoning Code <br />amendments for the City Council; and <br />WHEREAS, the City Council held a noticed public hearing on the proposed amendments <br />on September 21, 2015, at which time all interested parties had the opportunity to be heard; <br />and <br />WHEREAS, the City Council considered the staff report, the Planning Commission <br />recommendation, the recommended CEQA exemptions, all oral and written testimony, and <br />the materials in the record before taking action on the proposed amendments; and <br />WHEREAS, the Zoning Code amendments as recommended by the Planning Commission <br />are shown in attached Exhibits A-G, which are incorporated herein by reference. <br />NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN as <br />follows: <br />SECTION 1.Recitals. The above recitals are true and correct and made a part of this <br />ordinance. <br />SECTION 2. CEQA. Approval of the Zoning Code amendments is exempt from further <br />environmental review under the general rule in CEQA Guidelines Section 15061(b)(3) that <br />CEQA only applies to projects that have the potential for causing a significant effect on the <br />environment. As a series of text amendments and additions, it can be seen with certainty that <br />there is no possibility that the ordinance will have a significant effect on the environment. The <br />categorical exemption in Section 15305, Minor Alteration in Land Use Limitations also applies. <br />SECTION 3. Findings. Based on the entirety of the record, the City Council hereby <br />finds that the proposed amendments to the Zoning Code as shown in Exhibits A-G are <br />consistent with the policies of the General Plan, including the recently adopted Housing <br />Element Update. The City Council further finds that consideration of the proposed <br />amendments complied with the notice and hearing provisions of the Zoning Code. <br />SECTION 4. Approval.
