On April 20, 2015, the City Council modified two conditions of approval so that the <br /> Development Fee for Street Improvements and the Underground Utilities Conversion Fee shall be due at <br /> the issuance of the Certificate of Occupancy. <br /> NOW, THEREFORE, pursuant to the applicable provisions of the Zoning Code, it is mutually <br /> agreed as follows: <br /> 1. Applicant\Property Owner agrees to comply with the Conditions of Approval adopted by the <br /> City of San Leandro Board of Zoning Adjustments and as modified by the City Council as more <br /> specifically described in the Conditions of Approval, attached hereto, and as described in the exhibits on <br /> file in the Community Development Department, all of which are incorporated herein by this reference, <br /> although Applicant\Property Owner reserves its right to protest the imposition of the Conditions of <br /> Approval that were the subject of its administrative appeal (VII.0 and VII.D) per Government Code <br /> section 66020 et seq. The date of imposition of the Conditions of Approval that were the subject of <br /> Applicant\Property Owner's administrative appeal is April 20,2015. <br /> 2. This agreement shall be binding upon and inure to the benefit of the parties hereto and their <br /> respective heirs, successors,and assigns. <br /> 3. City is authorized to record this agreement and any amendments thereto with the Alameda <br /> County Recorder, California.
