11. INSURANCE: The Tenant, and any contractors and sub -contractors <br />making repairs, alterations or improvements for Tenant, shall obtain and keep insurance <br />as follows: <br />A. Tenant's Insurance Obligations. The Tenant shall procure and <br />maintain during the Term of this Agreement at Tenant's sole cost and expense the <br />following insurance (and increased yearly as applicable), and supply Landlord <br />certificates evidencing such insurance prior to execution by Landlord as follows: <br />(1) Comprehensive or commercial general liability insurance with <br />limits not less than Two Million Dollars ($2,000,000) each occurrence <br />combined single limit for bodily injury and property damage, including <br />contractual liability, independent contractors, sudden and accidental <br />pollution, broad -form property damage, fire damage legal liability. The <br />insurance coverage provided herein shall be primary coverage responding <br />to any and all structure and property losses related to Tenant's usage, <br />personal injury, products and completed operations, and explosion, <br />collapse and underground (XCU). If a Commercial General Liability <br />Insurance or an Automobile Liability form or other form with a general <br />aggregate limit is used, either the general aggregate limit shall apply <br />separately under this Agreement or the general aggregate limit shall be at <br />least twice the required occurrence limit. <br />(2) Fire and extended coverage with standard extended <br />coverage endorsement including vandalism and malicious mischief to the <br />extent of one hundred percent (100%) of its replacement value of all of <br />Tenant's fixtures, and other personal property from time to time situated in <br />the Leased Premises, and also on Tenant's leasehold improvements. The <br />proceeds of such insurance shall be held in trust to be used for the repair <br />or replacement of the improvements, fixtures and other property so <br />insured. <br />(3) Comprehensive or Business Automobile Liability Insurance <br />with limits not less than One Million Dollars ($1,000,000) each occurrence <br />Combined Single Limit for Bodily Injury and Property Damage including <br />coverage for Owned, Non -owned and Hired Vehicles, as applicable. <br />(4) Workers' Compensation, with Employer's Liability limits <br />(including employment practices coverage) not less than One Million <br />Dollars ($1,000,000) each, if applicable. <br />(5) If any policies are written on a claims -made form, Tenant <br />agrees to maintain such insurance continuously in force for three years <br />following completion of this Agreement or extend the period for reporting <br />claims for three years following the completion of this Agreement to the <br />effect that occurrences which take place during the contract period shall <br />be insured for the three years following the completion of the Agreement. <br />IT <br />
