�• <br /> IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 96 - 118 (2811) <br /> RESOLUTION APPROVING AND CONFIRMING REPORT, LEVYING <br /> ASSESSMENTS AND ORDERING IMPROVEMENTS <br /> HERON BAY MAINTENANCE ASSESSMENT DISTRICT NO. 96-3 <br /> Recitals <br /> The City Council has taken a series of actions preliminary to levying assessments <br /> and ordering the improvement in Heron Bay Maintenance Assessment District <br /> (Assessment District No. 96-3), City of San Leandro, Alameda County, California, as <br /> follows: <br /> 1. On May 6, 1996, the City Council adopted its resolution declaring its intention <br /> to order the formation of a Maintenance Assessment District pursuant to Chapter 5, Title <br /> II of the San Leandro Municipal Code (the "Code"), to pay the cost and expense of <br /> maintaining and operating certaining improvements and funding of the annual payment for <br /> maintenance of Plan area (collectively, the "Project"). The City Council referred the <br /> Project to Nystrom Engineering ("Nystrom"), as consulting engineers to the City, and <br /> authorized and directed them to prepare an Engineer's Report containing the matters <br /> required by Section 2-5-405 of the Code. <br /> 2. Nystrom filed the Report as directed, and the City Council, on May 20, 1996, <br /> adopted its resolution preliminarily approving the Report and fixing the date, time and <br /> place of two public hearings, as required by the Code. <br /> 3. Notice of the hearings was given by mailing to affected property owners and <br /> by publication, as required by the Code. A certificate of Mailing and a Proof of <br /> Publication have been filed with the City Clerk. <br />
