t . • <br /> consistent with this Agreement if required of either by the other. <br /> In the event of default or breach of this Agreement or any of its terms or conditions by the <br /> Participant or any successor in interest, the Agency may pursue the remedy thereof by all <br /> means of enforcement both in equity and law provided by the laws of the State of California, <br /> including the right of eminent domain with respect to any part of the property involved in the <br /> breach. <br /> III. [Section 300] USE OF THE SITE <br /> A. [Section 301] Uses <br /> Participant intends to construct and make improvements as set forth in Section 106 and <br /> Section 302 and Exhibit C hereof, and conduct activities which comply with the uses specified <br /> for the Site in the Plan. Participant covenants and agrees for itself, its successors, its assigns <br /> and every successor in interest to the Site or any part thereof, that Participant, such successors <br /> and assignees, shall devote the Site to, and only to, those uses permitted by the Plan. <br /> Improvements upon the Site shall be pursuant to plans and specifications approved by <br /> the City of San Leandro (the "City") and Agency, which approval shall not be unreasonably <br /> withheld or delayed, provided Participant's plans and specifications are in order and comply with <br /> all applicable codes and regulations. <br /> B. [Section 302] Improvements to the Site <br /> [Section 302.1] Participant shall construct an automobile dealership showroom <br /> for new automobile sales. The improvements shall be constructed in substantially the same <br /> manner as the Development Plan attached hereto as Exhibit B. <br /> [Section 302.2] Participant shall submit a landscaping plan for approval by <br /> the Development Services Director, which approval shall not be unreasonably withheld or <br /> delayed. <br /> [Section 302.3] Participant shall submit a master sign program for all <br /> signage. The signage shall comply with the San Leandro Municipal Code. <br /> [Section 302.4] Participant shall submit a lighting plan for approval by the <br /> Development Services Director, which approval shall not be unreasonably withheld or delayed. <br /> [Section 302.5.] Participant shall be required to dedicate right of way on Marina <br /> Boulevard to the width identified in the City's Revised Master Plan of City Streets adopted by <br /> Resolution No. 88-26. Participant shall install and maintain landscaping pursuant to Section <br /> 303.2 of this Agreement on the dedicated portion until Marina Boulevard is widened from <br /> Teagarden Street to Alvarado Street. Participant shall pay for all costs to construct right-of-way <br /> improvements including, but not limited to, pavement section, curb, gutters, sidewalk, street <br /> lights, utility relocations and other related appurtenances along the entirety of its frontage upon <br /> demand by the City or Agency, or in the alternative, in lieu of performing such work itself, <br /> Owner Participation Agreement Page 3 of 9 <br />
