. S OWNER PARTICIPATION AGREEMENT WITH F. H. DAILEY MOTOR COMPANY FOR THE DEVELOPMENT OF THE PROPERTY ON MARINA BOULEVARD, INCLUDING APN 075-0102-008-02 THIS OWNER PARTICIPATION AGREEMENT is between the REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO (the "Agency") and F. H DAILEY MOTOR COMPANY (the "Participant") (collectively, "Parties"). The Agency and the Participant agree as follows: Article One: SUBJECT OF AGREEMENT 1.01 Purposes of Agreement. The purpose of this Agreement is to provide for the development of a new Chevrolet Truck Satellite Sales Dealership("Dealership")on Marina Boulevard,San Leandro,CA,in furtherance of the Redeye opment Plan (the "Plan") for the Joint City of San Leandro - Alameda County Redevelopment Project Area (the "Project Area"). 1.02 The Redevelopment Plan. The Plan is the Alameda County-City of San Leandro Redevelopment Plan,which was approved and adopted on July 12, 1993, by the Board of Supervisors of the County of Alameda by Ordinance No 0-95-5, as amended, and by the City Council of the City of San Leandro by Ordinance No. 93-012, as amended. 1.03 Scope of Development. (a) Project Area. The Project Area is located in the City of San Leandro(the"City")and unincorporated areas of the County of Alameda, California,the boundary of which is specifically described in the Plan. (b) The Development. The Development will be a new Chevrolet Truck Satellite Sales Dealership located at 936 Marina Boulevard and the Necessary Property to be procured pursuant to Paragraphs 2.02.1 and 2.02 2 of this Agreement. The Dealership shall have a sales facility located in the current building located on 893 Marina Boulevard,which shall be remodeled for such purpose and according to construction plans approved pursuant to Articles Three and Four of this Agreement. The Development shall have a minimum frontage along Marina Boulevard of not less thar 150 feet and a minimum size of not less than 19,550 net square feet(after the provision of any required public street right-of-way). In addition,the Development shall have a front yard landscaped area of at least ten(10)feet, measured from the back of the sidewalk (including any future right-of-way), and a minimum ten (10) foot Owner Participation Agreement Page 1 of 18
