A. Each Lot in the Project is hereby declared to be subject <br />to the Project Easements that are appurtenant to the Lots <br />and for the benefit of all Owners and their invitees, the <br />Association and any suppliers of utilities or other <br />facilities to the Project. The Project Easements are <br />granted by Declarant for the non-exclusive use and benefit <br />of the Owners and their invitees, subject to the <br />obligations of each of the Owners and/or the Association to <br />maintain, repair and replacement all of such easements <br />throughout the term of this Declaration. <br />B. Except as provided in the Declaration, there shall be no <br />judicial partition of the Project Easement Area, nor shall <br />Declarant or any person acquiring an interest in all or any <br />part of the Project seek any judicial partition. <br />C. Subject to the provisions of this Declaration, each <br />Owner has nonexclusive rights of ingress, egress, support <br />and surface water drainage and run off through the Project <br />Easement Area. These rights shall be appurtenant to and <br />shall pass with title to every Lot. <br />D. The Members' rights of use and enjoyment of the Project <br />Easement Area shall be subject to the restrictions set <br />forth in the Governing Instruments, including the <br />following: <br />1. The right of the Association to adopt and enforce <br />Rules and Regulations for the use of the Project <br />Easement Area. <br />2. The right of the Association to reasonably limit <br />the number of guests and tenants using the Project <br />Easement Area. <br />3. The right of the Association to suspend the right <br />of any Owner, and the Persons deriving rights from any <br />Owner, to use and enjoy the Project Easement Area for <br />any period during which the Owner is substantially <br />delinquent in the payment of any assessment. <br />4. The right of the Association and/or the suppliers <br />of utilities to cause the construction of additional <br />improvements in the Project Easement Area, or to cause <br />the alteration or removal of existing improvements on <br />the Project Easement Area. <br />5. The right of the Association (through its Lot <br />Owners if legally required) to grant, consent to, or <br />join in the grant or conveyance of additional <br />easements, licenses, or rights-of-way in, on, or over <br />the Project Easement Area. <br />6. The rights of Declarant as described in this <br />Declaration. <br />E. Declarant hereby reserves easements for common driveway <br />El <br />
