Waste Oil Disposal and Pumpout Stations. Prior to the use of any berth,the permittee <br /> shall install at least one suitable facility, consistent with the U.S. Coast Guard's design and <br /> construction standards, for receiving and disposing of oily bilge water and other petroleum- <br /> based wastes. Such waste facility shall be maintained by the permittee in a safe, sanitary and <br /> operable condition. The permittee shall also maintain in a safe, sanitary and operable condition <br /> the two existing sewage pumpout stations, located immediately adjacent to the fuel dock at the <br /> harbor entrance. The pumpout facilities and the waste oil disposal facility shall be made <br /> available to boaters every day during normal boating hours. Use of the waste facilities shall <br /> either be free of charge or subject to a reasonable fee, imposed solely to cover the cost of the <br /> installation, maintenance and operation of the facilities. These waste facilities shall be clearly <br /> identified and located so that they can be easily seen and can be conveniently and safely <br /> reached by most boats in the water at all stages of the tide. <br /> K. Enforcement Responsibility.The permittee shall adequately enforce the requirements <br /> herein, and shall submit to the Commission the name, address, and telephone number of the <br /> person at the marina responsible for such enforcement. <br /> L. Restrooms, Showers and Garbage Disposal Facilities.The existing restrooms, showers, <br /> and garbage disposal facilities located in the marina shall be maintained in a safe and sanitary <br /> condition for marina users and their guests. All restroom facilities shall be available free of <br /> charge, conveniently located and open to marina users and their guests at all times. At least <br /> two restrooms facilities shall be open to the public during daylight hours, or longer at the <br /> discretion of the permittee. Should public use become a nuisance due to vandalism or <br /> inappropriate activities,the permittee may apply to the Commission upon a finding that (1) a <br /> public nuisance exists that has been identified and fully substantiated, (2)the further restriction <br /> or closure would likely correct the specific problems identified, and (3) no reasonable <br /> alternative measures exist that would impose less restriction on the public's use of the <br /> restroom facilities. <br /> M. Riprap Material and Placement <br /> 1. Riprap Material. Riprap material shall be either quarry rock or specially cast or <br /> carefully selected concrete pieces free of reinforcing steel or other extraneous <br /> material and conforming to quality requirements for specific gravity, absorption, and <br /> durability specified by the California Department of Transportation or the U.S. Army <br /> Corps of Engineers. The material shall be generally spheroid-shaped. The overall <br /> thickness of the slope protection shall be no more than three feet measured <br /> perpendicular to the slope. Use of dirt, small concrete rubble, concrete pieces with <br /> exposed rebar, large and odd-shaped pieces of concrete, and asphalt concrete as <br /> riprap is prohibited. <br />
