_ ' CONDITIONS OF APPROVAL <br />PLN2013-00016 <br />15420 Hesperian Boulevard (Tacos El Gordo) <br />Carlos Montero (Applicant and Property Owner) <br />I. COMPLIANCE WITH APPROVED PLANS <br />A. The applicant shall comply with Exhibits A through G, dated May 9, 2013, except <br />as hereinafter modified. The applicant and/or property owner shall be responsible for assuring that any <br />successor in interest who assumes responsibility for this zoning approval is <br />informed of its terms and conditions. Construction shall commence within one (1) <br />year following approval by the Zoning Enforcement Official and shall be <br />substantially completed one (1) year thereafter. For the purpose of compliance with <br />this condition, commencement of construction shall be defined as the pouring or <br />construction of a substantial portion of the building foundation. <br />C. Prior to issuance of building permits, the applicant and/or property owner shall <br />submit an outdoor staging and storage plan for the outdoor areas to be used for <br />equipment and materials during the construction of the new fast food restaurant <br />building. Said plan shall be subject to the review and approval of the Zoning <br />Enforcement Official, Alameda County Fire Marshall and the City Engineer. <br />II. PERMITTED USE <br />A. This Administrative Review approval and Outdoor Facility Permit grants <br />permission to construct a fast food restaurant with approximately 980 square feet of <br />floor area and an outdoor dining area with approximately 420 square feet of floor area <br />at 15420 Hesperian Boulevard; Alameda County Assessor's Parcel Number 80D- <br />559-3-4. Any change to the site plan or change to the hours of operation shall be <br />subject to the review of the Zoning Enforcement Official, who may approve it <br />administratively or deny the request. <br />B. Approval of this Administrative Review and Outdoor Facility Permit (PLN2013- <br />00016) hereby supersedes and makes void PLN2010-00071 Quality Tune-up, the <br />conditions of which were recorded against the property February 3, 2011, with <br />regards to 15420 Hesperian Boulevard. <br />PLN2013-00016 Agreement to Conditions <br />May 9, 2013 Page 3 of 14 <br />
