Compatible land uses include all those allowed in the inner portion of the airport <br />safety zone. Additional compatible land uses are open space for outdoor recrea- <br />tion, limited warehousing and storage, vehicle storage, and limited industry pro- <br />vided these land uses comply with density regulations specified in Subsection <br />C.1 above and height restrictions on structures and facilities contained in FAR <br />Part 77, including Subpart D. (FAR Part 77 is included in Appendix C to the Air- <br />port Land Use Policy Plan and kept on file with the Zoning Enforcement Official.) <br /> <br />3. Within the overall density limits established in Subsection C.1 above, clustering <br />of uses within a parcel may be compatible where such clustering provides emer- <br />gency landing areas, avoids concentration of development along the extended <br />runway centerline, and does not pose a hazard to air navigation. <br /> <br />4. Flammable liquids, as defined in the Uniform Fire Code, shall be stored under- <br />ground. <br /> <br />D. Use Permit Required. Any new development proposed for a parcel located within the <br />airport safety zone must secure a use permit from the Board of Zoning Adjustments. <br />The Board shall approve a use permit if it makes the findings required by Section 5- <br />2212 and determines that the proposed development is a compatible land use in that <br />portion of the safety zone in which the project will be located and meets the require- <br />ments of this section. <br /> <br />E. Noise and Aviation Easement. No land division shall be approved nor shall a permit of <br />any type be issued for any development within the airport safety zone until the City is <br />provided with a noise and aviation easement permitting the right of flight in the air- <br />space above the site. Such easement shall be supplied in a form prescribed by the <br />City Attorney and shall be recorded on the title of the property. The purpose of the <br />easement is to ensure that prospective property owners and developers are informed <br />and aware of the potential impacts of airport over-flights and operations. <br /> <br />F. Recorded Notice of Aircraft Over-flight Required. No land division shall be approved <br />nor shall a permit of any type be issued for any development activity within the airport <br />safety zone until a notice has been recorded in the Office of the County Recorder, <br />stating that the property is subject to aircraft over-flight. Such a notice shall include a <br />map showing the boundaries of the airport safety zone as adopted by the Alameda <br />County Airport Land Use Commission.
