The Zoning Enforcement Official may refer a fence modi- <br />fication request to the Board of Zoning Adjustments. The Board of Zoning Ad- <br />justments shall also review fence modification(s) requests that are made in con- <br />junction with an application for either a conditional use permit or variance. Ap- <br />peals of the decision of the Zoning Enforcement Official approving or denying a <br />fence modification shall be heard by the Board of Zoning Adjustments, pursuant <br />to the requirements of Article 28. (Ord. 2012-001 § 3; Ord. 2008-001 § 1; Ord. <br />2001-015 § 1) <br /> <br />4-1683 Adult-Oriented Business Regulations <br /> <br />A. Purpose and Intent. It is the intent of this article to prevent community wide adverse <br />economic impacts, increased crime, decreased property values, and the deterioration <br />of neighborhoods which can be brought about by the concentration of adult-oriented <br />businesses in close proximity to each other or proximity to other incompatible uses <br />such as schools for minors, churches, and residentially zoned districts or uses. The <br />City Council finds that it has been demonstrated in various communities that the con- <br />centration of adult-oriented businesses causes an increase in the number of transi- <br />ents in the area, and an increase in crime, and in addition to the effects described <br />above can cause other businesses and residents to move elsewhere. It is, therefore, <br />the purpose of this Article to establish reasonable and uniform regulations to prevent <br />the concentration of adult-oriented businesses or their close proximity to incompatible <br />uses, while permitting the location of adult-oriented businesses in certain areas. <br /> <br />B. Location Standards. <br /> <br />1. Subject to the provisions of this chapter, adult-oriented businesses shall be per- <br />mitted only in the Industrial Park (IP), Industrial Limited (IL), and Industrial Gen- <br />eral (IG), and Industrial Transition (IT) Districts, provided: <br /> <br />a. Each adult-oriented business shall, prior to commencement or continuation <br />of such business, first apply for and receive zoning approval from the Com- <br />munity Development Department. <br /> <br />b. Each such adult-oriented business must, prior to commencement or contin- <br />uation of such business, first apply for and receive an adult-oriented busi- <br />ness license. <br /> <br />c. Each such adult-oriented business must comply with all applicable develop- <br />ment and design regulations of the applicable zone. <br /> <br />d. No adult-oriented business shall be located in any zoning district with an <br />overlay zone. <br />
