IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2016-135 <br />RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A <br />CONSULTING SERVICES AGREEMENT WITH ATHEN B. GALLERY FOR THE <br />CURATION, INSTALLATION, AND MAINTENANCE OF MURAL ART IN FOUR SAN <br />LEANDRO LOCATIONS <br />WHEREAS, an agreement between the City of San Leandro and Athen B. Gallery, a copy <br />of which is attached, is presented to this City Council; and <br />WHEREAS, the City Council is familiar with the contents thereof; <br />WHEREAS, amendments to the agreement to clarify the work or respond to atypical <br />existing conditions are a normal aspect of public contracting and procurement of services; and <br />WHEREAS, in order to expedite the delivery of public projects on schedule and on budget, <br />provide that the subcontractors and workers are paid in a timely fashion, avoid as much as possible <br />costly delay claims, and ensure that the City completes projects according to the City's highest <br />standards, the City Council finds that providing authorization to negotiate and approve <br />amendments to the consulting services agreement is in the best interest of public welfare; and <br />WHEREAS, the City Manager recommends approval of said agreement. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />That said agreement is hereby approved and execution by the City Manager <br />is hereby authorized; and <br />That the City Manager or his designee is hereby authorized to negotiate and approve cumulative <br />amendments to the agreement up to a maximum of 25% of the original contract amount, or <br />$20,000. <br />Introduced by Vice Mayor Reed and passed and adopted this 17th day of October, 2016, <br />RESOLUTION NO. 2016-135 <br />
