2. Existing wireless telecommunications facilities are not of sufficient height to meet <br />applicant's coverage objectives. <br />3. Existing wireless telecommunications facilities do not have sufficient structural <br />strength to support applicant's proposed antenna(s) and related equipment. The <br />City may, at its discretion, require the applicant to submit a structural report pre- <br />pared by a qualified engineer as verification. <br />4. The applicant's proposed wireless telecommunications facility would cause radio- <br />frequency interference with an existing facility, or the existing facility would cause <br />interference with the applicant's proposed wireless telecommunications facility. <br />5. The applicant demonstrates that there are other limiting factors that render exist- <br />ing wireless telecommunications facilities unsuitable. <br />M. Discontinued Facilities and Removal of Abandoned Antennas and Towers. Any wire- <br />less telecommunications facility that is not operated for a continuous period of twelve <br />(12) months shall be considered abandoned, and the owner of such facility shall re- <br />move same, and restore the site to its pre -installation condition, within ninety (90) <br />days of receipt of notice from the Community Development Department Director noti- <br />fying the owner of such abandonment. The notice shall specify that the owner has the <br />opportunity to request a public hearing on the removal of the facility. If such facility is <br />not removed within said ninety (90) days, the Community Development Director may <br />remove such facility at the owner's expense. If there are two (2) or more users of a <br />single facility, then this provision shall not become effective until all users cease using <br />the facility. <br />Any wireless telecommunications facility shall be removed within thirty (30) calendar <br />days of the discontinuation of the use and shall be restored to its previous condition. The <br />service provider shall provide the Community Development Department with a notice of <br />intent to vacate the site a minimum of thirty (30) calendar days prior to vacation and <br />shall obtain building permits prior to removal of equipment. For facilities located on City <br />property, this requirement shall be included in the terms of the lease. For facilities locat- <br />ed on other sites, the property owner shall be responsible for removal of all antennas, <br />structures and related equipment within thirty (30) calendar days of the discontinuation <br />of use.
