File Number: 16-629 <br />There shall be a Housing Rehabilitation Appeals Board as defined by Section 19957.5 of the <br />California Health and Safety Code. The Housing Rehabilitation Appeals Board shall be <br />comprised of the same members as the Building Board of Appeals. The Building Official shall be <br />an ex officio nonvoting member and act as Secretary. <br />113.5 Building Code Enforcement Appeals Board. <br />In order to conduct the hearings provided for in Government Code Section 54988, there shall be a <br />Building Code Enforcement Appeals Board. The Building Code Enforcement Appeals Board <br />shall be comprised of the same members as the Building Board of Appeals. The Building Official <br />shall be an ex officio nonvoting member and act as Secretary. <br /> <br />113.6 Fees. <br />A fee as set forth in Chapter 4 of the San Leandro Administrative Code shall be paid to the <br />Building Official whenever a person requests a hearing before the appeals boards provided for in <br />this Section. <br />EXCEPTION: No fee shall be required for a hearing requested pursuant to Section 116 <br />SECTION 114 <br /> VIOLATIONS AND PENALTIES <br />114.1 Compliance with Code. <br />It shall be unlawful for a person, firm or corporation to erect, construct, enlarge, alter, repair, move, <br />improve, remove, connect, convert, demolish, equip, or perform any other work on any building or <br />structure or portion thereof, or cause the same to be done, contrary to, or in violation of, any of the <br />provisions of this Code. <br /> <br />114.2 Violation. <br />It shall be unlawful for any person to own, use, occupy or maintain any building or structure or <br />portion thereof, or cause the same to be done, contrary to, or in violation of, any of the provisions <br />of this Code. <br />114.3 Notice of violation. <br /> <br />The Building Official is authorized to serve a notice of violation or order on the property owner for <br />the erection, construction, alteration, extension, repair, moving, removal, demolition or occupancy <br />of a building or structure in violation of the provisions of this Code, or in violation of a permit or <br />certificate issued under the provisions of this Code.
