File Number: 16-629 <br />demolished. <br /> <br />116.7.2 Notice of hearing. <br />Not less than ten days prior to the hearing, the Building Official shall serve or cause to be <br />served either in the manner required by law for the service of summons or by first class mail, <br />postage prepaid or by posting as per Section 116.7.4 a copy of the notice of hearing upon the <br />property owner. <br />116.7.3 Form and contents of notice. <br />The notice of hearing shall state: <br />1. The street address and a legal description sufficient for identification of the <br />premises upon which the building or structure is located. <br />2. The conditions upon which the Building Official believes that the building, structure, <br />equipment or unoccupied building is unsafe. <br />3. The date, hour and place of the hearing. <br />116.7.4 Posting of notice. <br />The Building Official shall post one copy of the notice of hearing in a conspicuous place on <br />the unsafe building, structure, equipment or unoccupied building involved, not less than ten <br />days prior to the hearing. <br />116.7.6 Hearing by Building Board of Appeals. <br />The Building Board of Appeals shall hold a hearing and consider all competent evidence <br />offered by any person pertaining to the matters set forth in the report of the Building Official. <br />The Building Board of Appeals shall make written findings of fact as to whether or not the <br />building or structure is an unsafe building as defined in this Chapter. <br />116.7.7 Order. <br />If the Building Board of Appeals finds that the building, structure, equipment or unoccupied <br />building is an unsafe building, it shall make an order based on its finding that: <br />1. The building, structure, equipment or unoccupied building is unsafe and directing <br />that repairs be made and specifying such repairs, or <br />2. The building, structure, equipment or unoccupied building is unsafe and directing <br />that it be vacated and that specified repairs be made, or <br />3. The building, structure, equipment or unoccupied building is unsafe and directing <br />that it shall be vacated and demolished. <br />The order shall state the time within which the work required must be commenced after the <br />service of the order. The order shall state a reasonable time within which the work shall be <br />completed.
