CONDITIONS OF APPROVAL <br />PLN 16-0043 — 15041 Farnsworth Street <br />Best In The West Martial Arts Academy (Applicant) <br />and <br />Larry FingermI (Property,: Qww ..... _............... ......... <br />I. COMPLIANCE WITH APPROVED PLANS <br />A The property owner, and/or applicant shall comply with -Exhibit A and B. dated August 2 <br />2016 except as hereinafter modified. (Exhibits are on file at the City of San Leandro <br />Development Services Department, 835 East 14th Street, San Leandro, California). <br />Exhibit A — Site Plan <br />Exhibit A — Floor Plan <br />B. The property owner and/or applicant shall be responsible for assuring that any successor in <br />interest who assumes responsibility for the zoning approval is informed of its terms and <br />conditions. <br />C. Construction of tenant improvements shall commence within one (1) year following <br />Zoning Enforcement Official's approval of the Administrative Review and shall be <br />substantially completed one year after commencement of construction. For the purpose of <br />compliance with this condition, commencement of construction shall be defined as the <br />construction of a substantial portion of the tenant improvements <br />II. PERMITTED USES <br />A. This is an Administrative Review approval that allows martial arts instruction at 15041 <br />Farnsworth Street; Assessor's Parcel Number 80G-1374-2-5. <br />B. The days and hours of operation will be Monday -Friday from 4:00 p.m. to 8:30 p.m. and <br />Saturday between the hours of 10:00 a.m. to 2:00 p.m. <br />C. Any modification to the hours or days of operation, or relocation of the business on the <br />property or the expansion of the business shall be requested in writing to the Zoning <br />Enforcement Official. <br />D. This approval is for martial arts instruction only and the space is not to be used by the <br />applicant or rented out for any other activities or functions. <br />E. There shall be no sale or consumption of alcoholic beverages or food. <br />F. All doors shall be kept closed when music is being played. The volume of the music shall <br />not be detectable beyond the exterior boundary of the property. Any complaints received <br />by the City regarding noise from this use shall be re -reviewed by the Zoning Enforcement <br />Official to provide directive for the property owner or applicant to implement noise <br />controls or direct the matter to the Board of Zoning Adjustments for its consideration. <br />Agreement to Conditions September 15, 2016 <br />PLN 16-0043 Page 3 of 5 <br />
