File Number: 17-123 <br />in parking requirements for housing near transit, and Policy 59.04, which encourages <br />reductions in residential development fees for affordable housing. The proposed revisions <br />would waive parking requirements for housing within one-half mile of an AC Transit stop or <br />BART station and would reduce impact fees for accessory dwellings. <br />Environmental Review <br />The proposed amendments are statutorily exempt from the requirements of the California <br />Environmental Quality Act under Public Resources Section 21080.17 and do not have the <br />potential to cause a significant effect on the environment. <br />Planning Commission Recommendation and Action <br />The Planning Commission reviewed the attached text changes to the Zoning Code Article 5, <br />Section 2-576, “Accessory Dwelling Units,” at its public hearing on February 16, 2017. The <br />meeting audio from the Planning Commission’s hearing is available at: <br /><http://sanleandro.granicus.com/MediaPlayer.php?view_id=2&clip_id=878>. <br />In its deliberations, the Commission considered and made recommendations to the City <br />Council on two housing policy issues related to the Accessory Dwelling Unit ordinance: <br />·The Planning Commission recommended that the proposed ordinance allow both the <br />primary unit and ADU to be rented with no owner-occupancy requirements. <br />·The Planning Commission also recommended that the City continue prohibiting the <br />short-term rental of ADUs for less than 30 days in order to encourage the use of these <br />units as long-term rental housing, improving housing availability, and to discourage <br />their use as “hotel” type rentals. <br />The Planning Commission also amended staff’s recommendation with the following wording to <br />section (2-576)(D)(5)(b): <br />“A minimum of one additional independently accessibly off-street parking space shall <br />be required for the ADU, in addition to any existing parking spaces required for the <br />principal dwelling.” <br />In consultation with the City Attorney, staff is unable to recommend this amendment to the <br />Council, because an additional off-street parking space conflicts with the specific State <br />mandated parking criteria for ADUs. The Ordinance before the Council reflects the staff <br />recommendation in this instance. <br />With these considerations, the Planning Commission recommended the City Council adopt <br />the proposed Ordinance by a 5-0 vote. <br />Summary of Public Outreach Efforts <br />Notification of this meeting included a legal advertisement in the East Bay Times Daily Review <br />and posting of a notice of the meeting at City Hall a minimum of 72 hours in advance of the <br />Page 9 City of San Leandro Printed on 3/13/2017 <br />26
